THE Court of Appeal has ruled in favour of Aventus Group in a lease dispute with Home Consortium over a former Masters store at Cranbourne.
The Court of Appeal has set aside the decision of the trial judge in August last year.
Aventus and Home Consortium locked horns after Aventus refused to give consent to Home Consortium to sub-lease part of its Cranbourne premises, previously occupied by Masters.
The Court of Appeal found Aventus did not act unreasonably in regards to the requests.
The head lease remains on foot until 30 September 2030, including the guarantee by Woolworths for the performance by Home Consortium of its obligations under the head lease.
